A BILL to amend chapter thirty-three of the code of West Virginia,
one thousand nine hundred thirty-one, as amended, by adding
thereto a new article, designated article six-f, relating to
the privacy rights of West Virginia insureds; and providing
for commissioner authority to promulgate rules in accordance
with Title V of the Gramm-Leach-Bliley Act, Pub. L. 106-102
(1999).
Be it enacted by the Legislature of West Virginia:

That chapter thirty-three of the code of West Virginia, one
thousand nine hundred thirty-one, as amended, be amended by adding
thereto a new article, designated article six-f, to read as
follows:
ARTICLE 6F. DISCLOSURE OF NONPUBLIC PERSONAL INFORMATION.
§33-6f-1. Privacy; rules.

(a) No person shall disclose any nonpublic personal
information contrary to the provisions of Title V of the
Gramm-Leach-Bliley Act, Pub. L. 106-102 (1999).

(b) On or before the first day of July, two thousand one, the
commissioner shall propose rules for legislative approval in
accordance with article twenty, chapter twenty-nine-a of this code
necessary to carry out the provisions of Title V of the
Gramm-Leach-Bliley Act, Pub. L. 106-102 (1999) and this article.

(NOTE: The purpose of this bill is to comply with Title V of
the Gramm-Leach-Bliley Act, a federal law which requires states to
enact privacy rules applicable to the transaction of insurance.
