A BILL to amend article eight, chapter seven of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section
thirteen, relating to requiring persons incarcerated in
county or regional jails to pay for the costs of
incarceration for the first five days; and providing for
reimbursement of same when the person so incarcerated is
ultimately acquitted of the charges that resulted in the
Be it enacted by the Legislature of West Virginia:
That article eight, chapter seven of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
thirteen, to read as follows:
ARTICLE 8. JAIL AND JAILER.
§7-8-13. Reimbursement for costs of initial incarceration.
Notwithstanding any other provision of this code to the
contrary, any person who is arrested and incarcerated in a county
or regional jail shall pay to the county commission the actual
costs incurred for the first five days of incarceration:
Provided, That if a person is ultimately acquitted of the charges
which resulted in the incarceration, the county commission shall
reimburse the costs for incarceration paid to it by that person.
NOTE: The purpose of this bill is to require that persons
incarcerated in county or regional jails reimburse the county for
the costs incurred for the first five days of incarceration.
