This bill would permit magistrate courts to collect the service charge on behalf of the payee or holder of a dishonored check after a complaint has been presented to magistrate court. Current law permits a payee or holder to impose and collect the service charge prior to, but not after the complaint is filed.


SUGGESTED AMENDMENTS:Prepare committee substitute to include §61-3-39g which also refers to the prohibition on service charges following the filing of a complaint; clean up language relating to when a service charge may be imposed.
