Senate Concurrent Resolution No. 22

Sypolt, Guills, Kessler, Boley, Foster, Stollings, D. Facemire and Unger)



Requesting the Joint Committee on Government and Finance study the feasibility of a statewide database background check system.

Whereas, There exists a need for government and private employers to have the ability and access to background investigation checks on applicants for employment; and

Whereas, There are statutes in West Virginia that now provide for background investigation checks on applicants for employment at racetracks and such procedures should be available to state, county and municipal government as well as the private sector; and

Whereas, The Criminal Identification Bureau of the West Virginia State Police has a database that may be accessed by the 55 counties of the state and private sector employers in the counties; and

Whereas, Developing the means for state, county and municipal government as well as private employers to request background investigation checks on applicants for employment in this time of needed security is in the best interest of the citizens of the state and could be readily established in the office of the circuit
clerk of each county; therefore, be it
Resolved by the Legislature of West Virginia:

That the Joint Committee on Government and Finance is hereby requested to study the feasibility of a statewide database background check system; and, be it

Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2010, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it

Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
