A BILL to establish the Beckley-Raleigh county building code enforcement authority to serve the residents of the city of Beckley and Raleigh County; and providing the board with power and authority to regulate and govern the public interest, health, safety and welfare with regard to enforcing local building codes.

Be it enacted by the Legislature of West Virginia:
BECKLEY-RALEIGH COUNTY BUILDING CODE ENFORCEMENT AUTHORITY.
§1. Beckley-Raleigh county building code enforcement authority created; joint support by city of Beckley and the county commission of Raleigh County.

There is hereby created the Beckley-Raleigh County building code authority; which authority shall be supported by the city of Beckley and the county commission of Raleigh County, as a joint endeavor of the two governing authorities in the manner hereinafter provided.
§2. Board of directors; appointment, powers and duties generally; officers; bylaws and rules.

The authority is empowered to establish bylaws and promulgate rules regarding the governance of the authority and the enforcement of the appropriate state building codes.
The board of directors consists of five directors who serve without compensation. Each member of the board shall be one of the following: A licensed structural or civil engineer with architectural engineering experience, a licensed professional engineer, architect, builder or building superintendent with at least ten years of experience, during five of which the member has been in responsible charge of work: Provided, That no more than two appointees may be from the same profession. For the initial appointments, one member shall be appointed for a five-year term; one for a four-year term; one for a three-year term; one for a two-year term; and one shall be appointed for a one-year term. All other appointments are for five-year terms. The county commission shall appoint two members to the board; the city of Beckley shall appoint two members to the board; and the fifth member of the board shall be the president of the local contractors association. The city and county shall equally contribute funds for the operation of the authority.
Before the first day of July, two thousand one, the city of Beckley and the county commission shall may adopt the state building code and name their appointments to the board.



NOTE: The purpose of this bill is to create a building code enforcement authority to conduct its activities in the city of Beckley and Raleigh County.
