A BILL to amend and reenact §17C-16-8 of the Code of West Virginia, 1931, as amended, relating to creating a felony offense for making, issuing or using counterfeit auto inspection stickers; and providing a penalty for such violation.

Be it enacted by the Legislature of West Virginia:
That §17C-16-8 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:
ARTICLE 16. INSPECTION OF VEHICLES.
§17C-16-8. False certificates.

(a) No person shall make, issue, or knowingly use any imitation or counterfeit of an official certificate of inspection.
(b) No person shall display or cause or permit to be displayed upon a vehicle any certificate of inspection and approval knowing the same to be fictitious or issued for another vehicle or issued without an inspection having been made.

(c) Any person convicted of a violation of this section is guilty of a felony and, upon conviction thereof, shall be fined not more than one thousand dollars or imprisoned in a state correctional facility not less than one year, or both fined and imprisoned.



NOTE: The purpose of this bill is to make it a felony for persons to make, issue, or knowingly use any imitation or counterfeit of an official certificate of inspection and to impose a penalty for such crime.
