A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §30-3-13a, relating
to prohibiting a radiologist from performing a second reading
of an X ray without written authorization from the patient
when that X ray has previously been read and treatment
rendered by the primary physician.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §30-3-13a, to read as
follows:
ARTICLE 3. WEST VIRGINIA MEDICAL PRACTICE ACT.
§30-3-13a. Radiologists second readings of X rays; authorization.
When a primary physician has caused an X ray to be taken and
has read the X ray in the course of making a diagnosis and
rendering treatment to the patient, the physician may not send that X ray to a radiologist for a second reading after the patient's
treatment has begun without first obtaining written authorization
from the patient to do so.
NOTE: The purpose of this bill is to prohibit a radiologist
from performing a second reading of an X ray without first having
written authorization from the patient when the X ray has
previously been read and treatment rendered by the primary
physician.
