A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §8-15-9a, relating to mandating paid fire departments of Class I and Class II municipalities perform a study regarding achieving full compliance with NFPA 1710 by the thirtieth day of June, two thousand six.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §8-15-9a, to read as follows:
ARTICLE 15. FIRE FIGHTING; FIRE COMPANIES AND DEPARTMENTS; CIVIL SERVICE FOR PAID FIRE DEPARTMENTS.
PART III. PAID FIRE DEPARTMENTS.

§8-15-9a. Compliance with safety performance code for Class I and Class II municipalities.

(a) The Legislature finds that the State Fire Commission has accepted NFPA 1710 as the standard in this state for professional fire departments.
(b) All Class I and Class II municipalities are required to perform a study as to the implementation of NFPA 1710 with respect to the paid fire departments. This study shall be presented to the State Fire Commission on or before the thirtieth day of June, two thousand six.

NOTE: The purpose of this bill is to mandate Class I and Class II municipalities perform a study with respect to the implementation of NFPA 1710 for the fire departments. This study shall be presented to the State Fire Commission on or before June 30, 2006. NFPA 1710 contains minimum requirements relating to the organization and deployment of fire suppression, emergency medical operations, and special operations to the public by substantially all career fire departments.
