HOUSE RESOLUTION NO. 27

Urging
all members of the West Virginia delegation to the Congress
of the United States
to support any legislation that would
require satellite companies to offer local channels to their
subscribers.
Whereas, The Satellite Home Viewer Improvement Act of 1999
(SHVIA) permitted satellite companies to provide a local station's
signal to satellite subscribers in the local station's market; and
Whereas,
In 2004, Congress modified SHVIA to expand the
programming satellite companies can offer their subscribers; and
Whereas, SHVIA, even after the modifications, does not require
satellite companies to offer local channels. Rather, satellite
companies have the option of providing local service; and
Whereas, Satellite subscribers may be deemed subscribers
eligible to receive "distant signals," or stations that are outside
of the local television market. This means that a West Virginia
subscriber may not be able to receive local West Virginia channels,
but may receive local channels from cities outside of West
Virginia; and
Whereas, If a satellite provider chooses not to provide local
channels, a satellite subscriber must install an additional costly
digital antenna in order to receive local channels; and
Whereas, Oftentimes, even the installation of an antenna does
not provide all the desired local broadcast stations; therefore, be
it
Resolved by the House of Delegates:
That the House of Delegates of the 79th Legislature of the
State of West Virginia hereby respectfully urges all members of the
West Virginia delegation to the Congress of the United States
to
support any proposed laws that would require satellite companies to
provide local channels to its subscribers; and, be it
Further Resolved, That the Clerk of the House of Delegates forward certified copies of this resolution to all members of the
West Virginia delegation to the Congress of the United States.
