HOUSE JOINT RESOLUTION NO. 33

Proposing an amendment to the Constitution of the State of West Virginia, repealing section forty-six, article VI thereof; and amending article IX thereof by adding thereto a new section, designated section fourteen, all relating to the sale and distribution of alcohol; transferring authority to regulate sale and distribution of alcohol to county commissions or councils; numbering and designating such proposed amendment; and providing a summarized statement of the purpose of such proposed amendment.

    Resolved by the Legislature of West Virginia, two thirds of the members elected to each house agreeing thereto:

    That the question of ratification or rejection of an amendment to the Constitution of the State of West Virginia be submitted to the voters of the State at the next general election to be held in the year 2013, which proposed amendment is that section forty-six, article VI thereof be repealed; and that article IX thereof be amended by adding thereto a new section, designated section fourteen, to read as follows:

ARTICLE IX. COUNTY ORGANIZATION.

§14. Manufacture and Sale of Liquor.

    The county commission or council shall have the authority to regulate the manufacture and sale of intoxicating liquors, including the prohibition thereof, within the county limits, subject to the referendum approval of the voters of the county in the next regularly scheduled election.

    Resolved further, That in accordance with the provisions of article eleven, chapter three of the Code of West Virginia, 1931, as amended, the proposed amendment is hereby numbered "Amendment No. 1" and designated as the “County Liquor Sales Amendment” and the purpose of the proposed amendment is summarized as follows: “To amend the State Constitution to authorize the county commission or council the authority to regulate the sales and distribution of intoxicating liquors, including the prohibition thereof, within the county, subject to the approval of the voters in the next regular election.
