HOUSE JOINT RESOLUTION NO. 104

Proposing an amendment to the Constitution of the State of West Virginia, amending section nine, article VI thereof, relating to permitting the creation of single member delegate districts any time before the national 2020 census; permitting a district to contain fewer members, if it is presently a multiple member district, than it currently has anytime before the 2020 census; requiring single delegate member districts following the 2020 census; numbering and designating such proposed amendment; and providing a summarized statement of the purpose of such proposed amendment.

    Resolved by the Legislature of West Virginia, two thirds of the members elected to each house agreeing thereto:

    That the question of ratification or rejection of an amendment to the Constitution of the State of West Virginia be submitted to the voters of the State at the next general election to be held in the year 2012, which proposed amendment is that section nine, article VI thereof be amended, to read as follows:

ARTICLE VI. THE LEGISLATURE.

§9. Further apportionments.

    Until a new apportionment shall be declared, the apportionment of delegates to the counties not included in delegate districts, and to Barbour, Harrison and Taylor counties, embraced in such district, shall be as follows:

    To Barbour, Boone, Braxton, Brooke, Cabell, Doddridge, Fayette, Hampshire, Hancock, Jackson, Lewis, Logan, Greenbrier, Monroe, Mercer, Mineral, Morgan, Grant, Hardy, Lincoln, Pendleton, Putnam, Roane, Gilmer, Taylor, Tyler, Upshur, Wayne, Wetzel, Wirt, Pocahontas, Summers and Raleigh counties, one delegate each.

    To Berkeley, Harrison, Jefferson, Marion, Marshall, Mason, Monongalia and Preston counties, two delegates each.

    To Kanawha county, three delegates.

    To Ohio county, four delegates.

    At any time prior to the 2020 national census delegates, as declared by law, may be elected from districts containing a single member or may be elected from districts containing a fewer number of members than presently exists.

    Following the national 2020 national census, and at least every ten years thereafter, delegates, as declared by law, shall be elected from single member districts.

    Resolved further, That in accordance with the provisions of article eleven, chapter three of the Code of West Virginia, 1931, as amended, such proposed amendment is hereby numbered "Amendment No. 1" and designated as the "Single Delegate District Amendment" and the purpose of the proposed amendment is summarized as follows: "The purpose of this amendment is to permit members to the House of Delegates to be elected from single member districts, or to be elected from districts containing a number of members fewer than presently exists, prior to the 2020 United States census and to require all members to the House of Delegates be from single member districts following the 2020 United States census.”



 

    NOTE: The purpose of this resolution is to permit the creation of single member delegate districts any time before the national 2020 census. The resolution also permits a district to contain fewer members, if it is presently a multiple member district, than it currently has anytime before the 2020 census. The resolution requires single delegate member districts following the 2020 census.
