HOUSE CONCURRENT RESOLUTION NO.177

(By Delegates Manchin, Manypenny, Barill, Moye, Eldridge, Lynch, Poore and et.al)

 

 

Requesting the Joint Committee on Government and Finance to study the necessity of the application of oil and gas conservation law and lease integration principles to horizontal wells to promote the efficient development of oil and natural gas, prevent the waste of oil and gas resources, minimize the environmental footprint of oil and natural gas development, encourage the maximum recovery of oil and natural gas, and to protect the correlative rights of owners of oil and gas interests.

    Whereas, The Legislature finds that horizontal drilling has enabled production from formations underlying the state that were not economically feasible to extract with conventional drilling techniques; and

    Whereas, The Legislature finds that the horizontal drilling has provided great economic opportunity to the State of West Virginia; and

    Whereas, The Legislature desires to realize the benefits of low cost locally produced oil and natural gas by fostering the development of manufacturing and other industries that rely on locally produced oil and natural gas; and

    Whereas, The Legislature finds that to realize the economy-wide benefits of locally produced oil and gas interests, it is necessary to promote economically efficient and environmentally responsible development; and

    Whereas, In 1972, the Legislature enacted the West Virginia Oil and Gas Conservation Law to promote the economically efficient and responsible development of oil and natural gas from deep wells; and

    Whereas, The Legislature needs to examine the economic and environmental effects of horizontal well development without following Oil and Gas Conservation Law principles and to examine application of conservation law and lease integration principles to horizontal drilling to promote economically efficient and environmentally responsible extraction of oil and natural gas from horizontal wells; therefore, be it

    Resolved by the Legislature of West Virginia:

    That the Joint Committee on Government and Finance is hereby requested to study the necessity of the application of oil and gas conservation law and lease integration principles to horizontal wells to promote the efficient development of oil and natural gas, prevent the waste of oil and gas resources, minimize the environmental footprint of oil and natural gas development, encourage the maximum recovery of oil and natural gas, and to protect the correlative rights of owners of oil and gas interests; and, be it

    Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2014, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it

    Further Resolved, That the expenses necessary to conduct this study, to prepare a report and draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
