HOUSE CONCURRENT RESOLUTION NO. 164

(By Delegates Poling, M., Barill, Campbell, Craig, Eldridge, Ferro, Fleischauer, Fragale, Iaquinta, Jones, Lawrence, Marshall, Moye, Pasdon, Paxton, Perry, Pethtel, Phillips, L., Poling, D., Rowan, Staggers, Stephens, Stowers, Sumner, Wells and Williams)

 

 

Requesting the Joint Committee on Government and Finance to study the feasibility of electing the West Virginia State Board of Education.

    Whereas, The West Virginia Board of Education is appointed by the Governor; and

    Whereas, The West Virginia Board of Education is comprised of twelve members, including nine citizens appointed by the Governor and three nonvoting ex-officio members. The nonvoting ex-officio members are the State Superintendent of Schools, the Chancellor of the West Virginia Higher Education Policy Commission, and the Chancellor of Community and Technical College Education; and

    Whereas, State Board of Education members serve terms of nine years that overlap one another; and

    Whereas, No more than five members of the State Board of Education may belong to the same political party; and

    Whereas, Constitutional bodies such as the State Board of Education are not directly accountable to the voting population; therefore, be it

    Resolved by the Legislature of West Virginia:

    That the Joint Committee on Government and Finance is hereby requested to study the feasibility of electing members of the West Virginia State Board of Education; and, be it

    Further Resolved, That the Joint Committee on Government and Finance study the selection and election process for members of other states' education governance bodies; and, be it

    Further Resolved, That the Joint Committee on Government and Finance study the history of the West Virginia State Board of Education’s selection, appointment and election process; and, be it

    Further Resolved, That the Joint Committee on Government and Finance study the ideal composition of a State Board of Education for West Virginia, including the number of members representing each party and the variances between partisan and nonpartisan election, the total number of board members and length of terms; and, be it

    Further Resolved, That the Joint Committee on Government and Finance study the impact of the election of members of the West Virginia State Board of Education; and, be it

    Further Resolved, That the Joint Committee on Government and Finance study the duties of the State Board of Education including the path of authority between the State Board and the Superintendent, the Legislature and the Governor, to include powers and duties shared by, granted to, or constitutionally established for each; and, be it

    Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2014, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it

    Further Resolved, That the expenses necessary to conduct this study, to prepare a report and draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
