HOUSE CONCURRENT RESOLUTION NO. 137

(By Delegates Nelson, Anderson, Andes, Canterbury, Ellington, Ferns, Frazier, Hall, Miley, R. Phillips, Sigler, Snuffer and Stowers)

 

Requesting the Joint Committee on Government and Finance study the benefit of utilizing a lemon law for ATVs and motorcycles.

    Whereas, The consumers of West Virginia deserve protection in their purchases; and

    Whereas, Motorists have long been protected by the “lemon law” in their purchases of automobiles and trucks; and

    Whereas, It is the desire of the Legislature to provide protection for all West Virginia consumers; and

    Whereas, Other jurisdictions have found it wise to provide a “lemon law” for purchasers of high value motor vehicles such as all-terrain vehicles and motorcycles; therefore, be it

    Resolved by the Legislature of West Virginia:

    That the Joint Committee on Government and Finance study the benefit of utilizing a lemon law for ATVs and motorcycles; and, be it

    Further Resolved, That the Joint Committee on Government and Finance assign this study to the Joint Committee on Judiciary and that it report to the Legislature, on the first day of the regular session, 2013, on its findings, conclusions and recommendations, together with drafts of legislation necessary to effectuate its recommendations; and, be it

    Further Resolved, That the expense necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
