HOUSE CONCURRENT RESOLUTION NO. 110

Requesting that the Joint Committee on Government and Finance
authorize a study relating to
requiring blasting contractors
to notify the State Fire Marshal and local property owners
before blasting
.

HEREAS
, Blasting by contractors on construction projects
potentially impacts both the public safety and the safety of
neighboring property owners
; and
W
HEREAS
, It should be determined what rights a contractor has
in pursuing the construction project when balanced with the rights
of the public and neighboring property owners; and

HEREAS
, The Legislature is committed to protecting the public
through the regulation of construction projects; and
W
HEREAS
, The statutes governing the State Fire Commission
should be reviewed to consider any appropriate and necessary
revisions or additions to the laws and rules governing the use of
blasting materials; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to authorize a study relating to
requiring blasting
contractors to notify the State Fire Marshal and local property
owners before blasting
; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the Regular Session of the Legislature, 2010, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it
Further Resolved, That the Legislative expenses necessary to
conduct this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
