[Introduced February 22, 2010
; referred to the
Committee on Education.]
A BILL to amend and reenact §30-29-6 of the Code of West Virginia,
1931, as amended, relating to permitting a retired
law-enforcement officer to be employed by a county board of
education as a resource prevention officer in public schools.
Be it enacted by the Legislature of West Virginia:
That §30-29-6 of the Code of West Virginia, 1931, as amended,
be amended and reenacted to read as follows:
ARTICLE 29. LAW-ENFORCEMENT TRAINING AND CERTIFICATION.
§30-29-6. Review of certification.
(a) Certification of each West Virginia law-enforcement
officer shall be reviewed annually following the first
certification and until such time as the officer may achieve exempt
rank. Certification may be revoked or not renewed if any law-
enforcement officer fails to attend annually an in-service approved
law-enforcement training program, or if a law-enforcement officer achieving exempt rank fails to attend biennially an approved in-
service supervisory level training program. When a law-enforcement
officer is a member of the United States Air Force, Army, Coast
Guard, Marines or Navy, or a member of the National Guard or
reserve military forces of any such Armed Forces, and has been
called to active duty, resulting in separation from a law-
enforcement agency for more than twelve months but less than
twenty-four months, he or she shall attend and complete the
mandated in-service training for the period and rank and qualify
with his or her firearm within ninety days from his or her
reappointment as a law-enforcement officer by a law-enforcement
agency.
(b) Following his or her retirement from service as a law-
enforcement officer by a law-enforcement agency, an officer may be
employed by a county board of education as a resource prevention
officer in public schools. To be eligible for employment by the
county board, the officer shall maintain certification as a law-
enforcement officer as required by this section and section five of
this article. A retired officer employed pursuant to this
subsection is authorized to maintain certification after retirement
consistent with the requirements for continuing certification
established by this article. A retired officer so employed and
certified maintains all powers and duties of law-enforcement
officers that he or she held while employed by a law-enforcement
agency. If at any time the officer's certification is revoked or not renewed, the officer is no longer eligible for employment by a
county board.
NOTE: The purpose of this bill is to permit a retired law-
enforcement officer to be employed by a county board of education
as a resource prevention officer in public schools.
