A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §22C-3-27, relating to abolishing the Solid Waste Management Board and transferring its powers, duties, responsibilities, employees, equipment and records to the Secretary of the Department of Environmental Protection; and continuation of programs and rules.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §22C-3-27, to read as follows:

ARTICLE 3. SOLID WASTE MANAGEMENT BOARD.

§22C-3-27. Solid Waste Management Board abolished; transfer of duties and responsibilities; transfer of employees, equipment and records; continuation of programs, protections and rules.

    (a) Upon the effective date of this statute, the Solid Waste Management Board is abolished. All duties and responsibilities heretofore imposed upon the Solid Waste Management Board are hereby imposed upon the Secretary of the Department of Environmental Protection.

    (b) Persons employed on the effective date of this section by the Solid Waste Management Board, the duties and functions of which have been transferred to the Secretary of the Department of Environmental Protection, are hereby assigned and transferred to the Department of Environmental Protection. It is the intent of this section to consolidate into the Department of Environmental Protection, those employees performing personnel functions which will be facilitated by their consolidation.

    (c) On the effective date of this section, all equipment and records necessary to effectuate the purposes of this section are transferred to the secretary.

    (d) The rules of the Solid Waste Management Board shall remain in force until promulgation of new or additional rules by the secretary.



    NOTE: The purpose of this bill is to abolish the Solid

Waste Management Board and transfer its powers, duties, responsibilities, employees, equipment and records to the Secretary of the Department of Environmental Protection.
