Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto to a new section, designated §15-9A-4, to read as follows:

§15-9A-4. Fund for civil legal services for low income persons.

    (a) There is hereby established in the State Treasury a special revenue account, designated as the "Fund for Civil Legal Services for Low Income Persons," which shall be an appropriated fund for receipt of grants, gifts, fees, or federal or state funds designated for civil legal services for low income persons. Expenditures from the fund shall be limited to grants to nonprofit agencies which provide civil legal services to low income persons. The director is given the duty and powers necessary to make the grants.

NOTE: The purpose of this bill is to authorize, and give the director of the Division of Justice and Community Services the duty and authority, to make grants from state and other funds to provide civil legal services to low income persons.

§15-9A-4 is new; therefore, it has been completely underscored.
