A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §5A-6-4d, relating to requiring all state agencies to develop a plan to evaluate a transition to cloud based data storage; reporting requirements.

Be it enacted by the Legislature of West Virginia:

ARTICLE 6. OFFICE OF TECHNOLOGY.


§5A-6-4d. Requirement for all agencies to develop plan for cloud based data storage.

(a) In order to move towards a more reliable and cost-effective means of data storage, each state agency shall develop a comprehensive written plan to evaluate its transition to cloud-based data storage. The plan should address the following items, including, but not limited to:

(1) The identification of any sources of agency data not currently stored in cloud-based storage; and

(2) Current costs of hardware storage of data; and    

(3) Of the sources of data identified in subdivision one of this subsection, the plan should address:

(i) Whether there are privacy concerns regarding the data; and

(ii) Whether an internet outage could affect the ability of the agency to serve its’ mission; and

(iii) Whether the agency can take further steps to mitigate identified risks.

(4) The cloud-based storage service type needed; and

(5) Cost estimates for transitioning to cloud-based data storage.

(b) Each agency shall work in conjunction with the Office of Technology to develop the plan required by subsection (a) of this section.

(c) Each agency should complete the plan described in subsection (a) of this section and provide it to the Joint Committee on Government and Finance no later than January 1, 2019.

 

NOTE: The purpose of this bill is to require all state agencies to develop a plan to evaluate a transition to cloud based data storage, and includes reporting requirements.
