A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §16-2-11a, relating to requiring local governmental bodies to approve rules promulgated by local boards of health.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §16-2-11a, to read as follows:
ARTICLE 2. LOCAL BOARDS OF HEALTH.
§16-2-11a. Local government approval of local health board rules
(a) A rule promulgated by a local board of health requires the approval by a majority vote of each of the board’s appointing authorities.
(b) Appointing authorities may not withhold approval of rules promulgated by a local board of health that are required to carry out federal and state laws, regulations or rules.
NOTE: The purpose of this bill is to require local governmental bodies to approve the rules promulgated by local health boards.
