A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §38-5A-2a; and to
amend said code by adding thereto a new section, designated
§38-5B-4a, all relating to requiring judgment debtors to
report to the court wherein final judgment was rendered
against them any changes in employment.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §38-5A-2a; and that
said code be amended by adding thereto a new section, designated
§38-5B-4a, all to read as follows:
ARTICLE 5A. SUGGESTIONS OF SALARY AND WAGES OF PERSONS ENGAGED IN
PRIVATE EMPLOYMENT.
§38-5A-2a. Change of employment to be reported by judgment debtor.
Whenever a judgment debtor, subject to suggestion by judgment creditors as provided by this article, changes employment, he or
she shall notify the court wherein final judgment was entered of
such change of employment.
When the judgment debtor does not comply with the provisions
of this section the judgment debtor may be held in contempt of
court.
ARTICLE 5B. SUGGESTION OF THE STATE AND POLITICAL SUBDIVISIONS;
GARNISHMENT AND SUGGESTION OF PUBLIC OFFICERS.
§38-5B-4a. Change of employment to be reported by judgment debtor.
Whenever a judgment debtor, subject to suggestion by judgment
creditors as provided by this article, changes employment, he or
she shall notify the court wherein final judgment was entered of
such change of employment.
When the judgment debtor does not comply with the provisions
of this section the judgment debtor may be held in contempt of
court.
NOTE: The purpose of this bill is to require judgment debtors
to report to the court wherein final judgment was rendered against
them changes in employment.
§§38-5A-2a and 38-5B-4a are new; therefore, strike-throughs
and underscoring have been omitted.
