A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §16-5D-5a, relating
to requiring assisted living residences to maintain adequate
auxiliary power sources to generate electricity in the event
of an extended power outage.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §16-5D-5a, to read as
follows:
ARTICLE 5D. ASSISTED LIVING RESIDENCES.
§16-5D-5a. Auxiliary power in event of disaster or other
emergency.
(a) Because of the ages and infirmities of assisted living
residents, the Legislature finds that assisted living residences
should maintain adequate auxiliary power sources to generate electricity in the event of an extended power outage resulting from
a disaster or other emergency to reduce the severe hardship caused
by relocating these residents.
(b) On or before the first day of October, two thousand seven,
every assisted living residence licenced pursuant to article
five-d, chapter sixteen of this code shall maintain on site backup
power generators capable of generating sufficient auxiliary
electrical power to maintain basic services to residents during an
extended power outage resulting from a disaster or other emergency.
NOTE: The purpose of this bill is to require assisted living
residences to maintain adequate auxiliary power sources to generate
electricity in the event of an extended power outage.
