A BILL to amend article seven, chapter sixty-four of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
six, relating to amending the West Virginia Racing Commission
greyhound racing rule relating to definitions used therein and
the greyhound breeding development fund.
Be it enacted by the Legislature of West Virginia:
That article seven, chapter sixty-four of the code of West
Virginia; one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section six, to
read as follows:
ARTICLE 7. AUTHORIZATION FOR DEPARTMENT OF TAX AND REVENUE TO
PROMULGATE LEGISLATIVE RULES.
§64-7-6. Racing Commission; Greyhound Racing.
The legislative rule contained in title one hundred seventy-
eight, series two, and filed in the state register on the thirtieth
day of April, two thousand four, under the authority of section
six, article twenty-three, chapter nineteen of this code, relating
to the Racing Commission (greyhound racing rules, 178 CSR 2) is
reauthorized with the following amendment:
On page two, section two, subsection 2.15, before the word
"owner" by inserting the word "registered" and before the word
"lessee" by inserting the word "registered" and by striking the
word "whelping" and inserting in lieu thereof "breeding";
On page four, section two, subsection 2.68, before the word
"meeting" by inserting the words "time of breeding, whelping and
racing at the meeting";
On page thirty-nine, section fifty-one, subsection 51.2,
before the word "owner", by inserting the word "registered" and by
striking the words "or lessee" and by inserting before the word
"member" the phrase "bona fide resident of the state and a";
On page thirty-nine, section fifty-one, subsection 51.3, by
striking the words "An Owner" and inserting in lieu thereof "All
registered owners" and by inserting before the word "member" the
phrase "bona fide resident of the state and a";
and
On page thirty-nine, section fifty-one, subsection 51.4, by striking the words "The owner or lessee shall" and inserting in
lieu thereof "All registered owners or lessees shall be a bona fide
resident of this state and".
NOTE: The purpose of this bill is to modify rules regulating
greyhound racing in this state whether live or by simulcast, the
conducting of pari-mutuel wagering at greyhound race tracks, and
the breeding of greyhounds for racing.
