H. B. 3048

(By Delegates White, Campbell,

[Introduced March 10, 2009; referred to the

A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §5-16-24a, relating to additional fees to employer for paper transactions with the Public Employees Insurance Agency.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §5-16-24a, to read as follows:

ARTICLE 16. WEST VIRGINIA PUBLIC EMPLOYEES INSURANCE ACT.

§5-16-24a. Paper transactions.

The director may, by rule as authorized in section nine of this article, establish a fee not to exceed $5 per transaction which the Public Employees Insurance Agency may charge to employers for performing business transactions with the agency by paper when the transaction could be performed electronically.

NOTE: The purpose of this bill is to permit PEIA to promulgate a rule to charge fees to employers who transact business with the agency by paper when more efficient and less expensive electronic transactions are available.

Strike-throughs indicate language that would be stricken from the present law, and underscoring indicates new language that would be added.
