A BILL to amend article ten, chapter sixty-one of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section five-a,
relating to making it a misdemeanor for a person under the age
of twenty-one to enter into any game of chance.
Be it enacted by the Legislature of West Virginia:
That article ten, chapter sixty-one of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section five-a,
to read as follows:
ARTICLE 10. CRIMES AGAINST PUBLIC POLICY.
§61-10-5a. Betting on games of chance; furnishing money or thing
of value therefor; penalty.
If any person over the age of seventeen but under the age of
twenty-one years at any place, public or private, bet or wage money
or other thing of value on any game of chance, whether or not the
game of chance is sanctioned by, or licensed under, the laws of
this state, he or she is guilty of a misdemeanor and, upon
conviction, shall be fined not less than fifty nor more than five
hundred dollars.
NOTE: The purpose of this bill is to make it a misdemeanor for
a person under the age of twenty-one to engage in any form of
gambling.
