A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §16-2I-11, relating to making it a misdemeanor to violate the informed consent requirements for an abortion; and providing criminal penalties for violation.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §16-2I-11, to read as follows:

ARTICLE 2I. WOMEN'S RIGHT TO KNOW ACT.

§16-2I-11. Failure to comply with this article.

The penalty for failure to comply with this article shall be a misdemeanor punishable by a fine that is triple the amount of the abortion for which informed consent was not provided. A second offense shall result in the permanent closing of the facility in
which said abortion is performed.
Nothing in this section shall be construed or interpreted to condone, permit, allow or endorse any abortion.





NOTE:
The purpose of this bill is to make it a misdemeanor to violate the informed consent requirements for an abortion ; and provide criminal penalties.
