A BILL amend and reenact §30-7B-2 of the Code of West Virginia, 1931, as amended; and to amend said code by adding thereto a new section, designated §30-7B-10, all relating to certified professional midwives; and requiring the reporting of specified information.
Be it enacted by the Legislature of West Virginia:
     That §30-7B-2 of the Code of West Virginia, 1931, as amended, be amended and reenacted and that said code be amended by adding thereto a new section, designated §30-7B-10, all to read as follows:
ARTICLE 7B. CENTER FOR NURSING.
§30-7B-2. Definitions.
     (a) "Board" means the board of directors for the West Virginia Center for Nursing.
     (b) "Center" means the West Virginia Center for Nursing.
     (c) "Certified professional midwife" means a person who has met the standards for certification and is certified by the North American Registry of Midwives.
     ~~(c)~~ (d) "Direct patient care" ~~as used in this article,~~ means health care that provides for the physical, emotional, diagnostic or rehabilitative needs of a patient, or health care that involves examination, treatment or preparation for diagnostic tests or procedures.
§30-7B-10. Certified professional midwife reports.
_____A certified professional midwife shall report to the center annually in a manner and form prescribed by the center. The report shall be submitted by January 31 of each year and shall include all of the following:
_____(1) The certified professional midwife's name;
_____(2) The calendar year being reported;
_____(3) The total number of clients served;
_____(4) The total number and county of live births attended as a primary caregiver;
_____(5) The total number and county of stillbirths attended as a primary caregiver;
_____(6) The number of patients whose primary care was transferred to another health care provider during the antepartum period and the reason for each transfer;
_____(7) The number, reason and outcome for each elective hospital transfer;
_____(8) The number, reason and outcome for each emergency transport of an expectant mother prior to labor;
_____(9) A brief description of any complications resulting in the mortality of a mother or an infant; and
_____(10) Any other information prescribed by the center through legislative rule.

     NOTE: The purpose of this bill is to require certified professional midwives to report certain information to the Center for Nursing.
