A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §17-2A-8d, relating to requiring the Commissioner of Highways to contract with private providers or contractors for necessary emergency maintenance operations.

Be it enacted by the Legislature of West Virginia:

            That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §17-2A-8d, to read as follows:

ARTICLE 2A. WEST VIRGINIA COMMISSIONER OF HIGHWAYS.

§17-2A-8d. Contracts with private providers or contractors for emergency maintenance operations.

            In addition to the other powers given and assigned to him or her in this chapter, the Commissioner of Highways may, in consultation with the regional engineers or superintendents, or both regional engineers and superintendents, contract with private providers or contractors for those operations to promote the safety and general welfare of the traveling public, school systems and activities of commerce which cannot be accomplished by the Division of Highways in a timely manner. These potential operations may include, but are not limited to, snow and ice removal and cleaning of debris from and beside roadways.

 


            NOTE: The purpose of this bill is to require the Commissioner of Highways to contract with private providers or contractors for necessary emergency maintenance operations.


            §17-2A-8d is new; therefore, it has been completely underscored.
