A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §33-6-38, relating to prohibiting insurers providing automobile and homeowners insurance from increasing the rates for persons over the age of sixty-five based solely on their age.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §33-6-38, to read as follows:
ARTICLE 6. THE INSURANCE POLICY.

§33-6-38. Prohibition against raising rates of automobile and homeowners insurance of persons over sixty-five.
No insurer may increase the rates for coverage of automobile liability insurance or homeowners insurance for persons over the age of sixty-five for the sole reason of a person's age.
NOTE: The purpose of this bill is to prevent insurers from increasing the rates for coverage of automobile liability insurance and homeowners insurance for persons over the age of sixty-five for the sole reason of a person's age.
