A BILL to amend chapter thirty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new article, designated article fifteen-c, relating to the creation of the West Virginia industrial park shell building and jobs act; legislative findings; funding from bureau of commerce development office; lease of buildings to local development; additional funding from appropriations, gifts or grants; and promulgation of rules.

Be it enacted by the Legislature of West Virginia:

That chapter thirty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new article, designated article fifteen-c, to read as follows:

ARTICLE 15C. WEST VIRGINIA INDUSTRIAL PARK SHELL BUILDING AND JOBS ACT.
§31-15C-1. Short title.
This article shall be known and may be cited as the "West Virginia Industrial Park Shell Building and Jobs Act."
§31-15C-2. Legislative purpose.

The purpose of this article is to stimulate economic growth and job creation and retention through the development of shell buildings in the industrial parks which will accommodate businesses and industries. These shell buildings will provide infrastructure support and opportunities for new and existing businesses and also promote efficient use of the state's abundant natural resources.
§31-15C-3. Funding.

The state shall provide funds through the bureau of commerce development office to construct shell buildings. Development and use of the shell buildings may be achieved through partnerships with the private sector. Funding may also be established from appropriations made by the Legislature, public and private grants, the West Virginia infrastructure and jobs development council and other sources.
§31-15C-4. Lease of shell buildings.
The bureau of commerce may lease shell buildings to local development offices which may sublease to public entities and private businesses.
§31-15C-5. Secretary to promulgate rules.

The secretary of commerce shall propose rules for legislative approval in accordance with the provisions of article three, chapter twenty-nine-a of this code to determine locations for industrial park shell buildings and the eligibility of businesses and public entities to lease these facilities.

NOTE: The purpose of this bill is to authorize the Bureau of Commerce Development Office to construct shell buildings at industrial parks to accommodate businesses and industries.
