A BILL to amend article fifteen, chapter sixteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto two new sections, designated sections twenty-six and twenty-seven, all relating to requiring cooperation among state agencies in verifying eligibility for public housing programs.

Be it enacted by the Legislature of West Virginia:

That article fifteen, chapter sixteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto two new sections, designated sections twenty-six and twenty-seven, all to read as follows:

ARTICLE 15. STATE HOUSING LAW.

§16-15-26. Verification of eligibility.

A public housing authority may obtain information from the department of tax and revenue, division of employment security, department of health and human resources and the workers' compensation commission for the purpose of assistance in verifying the eligibility of a person for any public housing program. The request for this information must be in writing and specify the exact information requested, together with sufficient information to allow these agencies positively to identify the correct person. The authority may forward the request either to the main agency address or to a local branch and the agency shall provide an expeditious written response.

§16-15-27. Providing information of unemployment insurance; costs.
(a) The division of employment security shall furnish, upon request of any public agency administering the aid to families with dependent children and child support programs or any public housing authority, any information in its possession relating to:
(1) Individuals who are receiving, have received or have applied for unemployment insurance;
(2) The amount of benefits being received;
(3) The current home address of such individuals; and
(4) Whether any offer of work has been refused and, if so a description of the job and the terms, conditions and rate of pay for the job.
(b) The requesting agency shall be responsible for reimbursing the division of employment security for actual costs incurred in supplying the information.



NOTE: The purpose of this bill is to require state agencies to provide information for verifying eligibility for public housing programs.
