A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §9-5-24, relating to managed care.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section , designated §9-5-24, to read as follows:
ARTICLE 5. MISCELLANEOUS PROVISIONS.
§9-5-24. Prohibiting certain changes to managed care.
Neither the department, or its Bureau of Medical Services shall apply for a federal waiver necessary to gain federal approval to either add a new Medicaid benefit category or to add an additional Medicaid eligibility group to the Medicaid managed care program without legislation authorizing the submission of such waiver.
NOTE: The purpose of this bill is to prohibit the Department of Health and Human Resources from expanding the managed care population without authorization from the Legislature.
