A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §4-1-2a, relating to directing one half of any budget surplus in a fiscal year equally to every West Virginia family or individual within two hundred percent of the poverty level in the form of a tax rebate to be mailed July 1, 2007; and providing rule-making authority to the Tax Commissioner for implementing this rebate.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §4-1-2a, to read as follows:
ARTICLE 1. OFFICERS, MEMBERS AND EMPLOYEES; APPROPRIATIONS;
INVESTIGATIONS; DISPLAY OF FLAGS; RECORDS; USE OF
CAPITOL BUILDING; PREFILING OF BILLS AND
RESOLUTIONS; STANDING COMMITTEES; INTERIM MEETINGS;
NEXT MEETING OF THE SENATE.
§4-1-2a. Budget surplus to be given as rebate; rulemaking.
Notwithstanding any provision of this code to the contrary, beginning with the fiscal year two thousand seven, one half of any budget surplus in a fiscal year shall be given equally to every West Virginia family or individual whose annual gross income is within two hundred percent of the poverty level in the form of a tax rebate to be mailed on the first day of July. For the purposes of this section, "budget surplus" means the actual general revenue collections minus the general revenue budget passed by the Legislature for the applicable fiscal year.
The Tax Commissioner may propose rules for the administration of this section for legislative approval in accordance with article three, chapter twenty-nine-a of this code.


NOTE: The purpose of this bill is to
direct one half of any budget surplus in a fiscal year equally to every West Virginia family or individual whose gross income is within 200% of the poverty line in the form of a tax rebate to be mailed on July 1, 2007 .
