A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §20-2-11a, relating
to McKinsie's Law; prohibiting the exposure of any game that
has been gutted or cleaned from the public's view when
reasonably possible; and providing a penalty.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §20-2-11a, to read as
follows:
ARTICLE 2. WILDLIFE RESOURCES.
§20-2-11a. Exposing gutted game to the public prohibited;
penalties.
A person may not expose any game that has been gutted or
cleaned to the public without making reasonable efforts to conceal the game from the public's view when reasonably possible. "Gutted
or cleaned" means removing the hair, skin or inner organs of any
game.
A person that violates this section is guilty of a misdemeanor
and, upon conviction thereof, shall be fined not less than fifty
dollars nor more than one hundred dollars. A person that violates
this section for a second offense or subsequent offense is guilty
of a misdemeanor and, upon conviction thereof, shall be fined not
less than one hundred dollars nor more than five hundred dollars.
NOTE: The purpose of this bill is to establish McKinsie's Law
by prohibiting the exposure of any game that has been gutted or
cleaned from the public's view when reasonably possible; and to
provide a penalty.
