A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §15-12-2c, relating to requiring sex offenders to pay a fee which is to be deposited into the State Police Retirement Fund; and providing penalties.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §15-12-2c, to read as follows:
ARTICLE 12. SEX OFFENDER REGISTRATION ACT.
§15-12-2c. Registration fees and penalty for failing to pay.

(a) A person who is required to register under this article, or who changes registry information as required under this article, is required to pay a fee of $25 at the time of registration or when making a change in registry information. If at the time of registration, or when changing registry information, the person is unable to pay the fee, the State Police may allow the person sixty calendar days to pay the fee or may waive the fee. Fees collected pursuant to this section shall be deposited into the West Virginia State Police Retirement System.
(b) Any person who fails to pay the required fee under this section is guilty of a misdemeanor and, upon conviction, shall be confined in jail for not more than ten days or fined not more than $100, or both fined and confined. In addition to or in lieu of the punishment prescribed herein, the court may require the person found guilty of such misdemeanor to participate in the litter control program.

(NOTE: The purpose of this bill is to require registered sex offenders to pay a fee at the time of registration or when registration information changes that will be deposited in the West Virginia State Police Retirement System.
