A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §22-11-31, relating to the West Virginia Water Research Institute’s development of a method for assessing the state’s narrative water quality standards; and determining whether streams meet the federal Clean Water Act’s designated use requirements.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §22-11-31, to read as follows:

ARTICLE 11. WATER POLLUTION CONTROL ACT.

§22-11-31. Assessment of narrative water quality standards by West Virginia Water Research Institute.

    (a) The West Virginia Water Research Institute, in conjunction with the West Virginia Department of Environmental Protection, shall develop a method for assessing compliance with the state’s narrative water quality standards that may be used by the West Virginia Environmental Protection Agency to determine whether a stream meets the Federal Clean Water Act’s designated use requirements. The method will consider all components of the aquatic ecosystem.

    (b) The West Virginia Water Research Institute shall report to the Legislature on the development on this aquatic ecosystem assessment and stream use attainment method within six months. A final report shall be issued by the West Virginia Water Research Institute to the Legislature within one year from the effective date.

    (c) Based upon the report, the Legislature may pass legislation utilizing the assessment method and reevaluating previous stream impairment listings based on this new assessment tool if the Legislature finds that the assessment method is consistent with the goals and objectives of the West Virginia Water Pollution Control Act.





    NOTE: The purpose of this bill is to require the West Virginia Water Research Institute to develop a method for assessing the state’s narrative water quality standards and determining whether streams meet the federal Clean Water Act’s designated use requirements.
