A BILL to amend article three, chapter twenty-nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section twenty-one-a, relating to creating the offense of damaging fire safety systems or equipment in a jail or correctional facility; and penalties.

Be it enacted by the Legislature of West Virginia:
That article three, chapter twenty-nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section twenty-one-a, to read as follows:
ARTICLE 3. FIRE PREVENTION AND CONTROL ACT.
§29-3-21a. Damaging fire safety equipment in prisons and jails; penalties.

A person who willfully destroys, damages or disables a fire safety system or fire safety equipment, including, but not limited to, a fire extinguisher, fire alarm, sprinkler system or standpipe system, situated in a county or regional jail or state correctional facility is guilty of a misdemeanor and, upon conviction thereof, shall be incarcerated in a state correctional facility, county or regional jail for not less than six months nor more than one year.
