A BILL to amend article three, chapter twenty-four of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section one-c, relating to requiring verification of approved septic or sewage disposal system before connection of public utilities to residential or commercial structures utilizing individual on-site systems.

Be it enacted by the Legislature of West Virginia:
That article three, chapter twenty-four of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section one-c, to read as follows:
ARTICLE 3. DUTIES AND PRIVILEGES OF PUBLIC UTILITIES SUBJECT TO REGULATIONS OF COMMISSION.
§24-3-1c. Verification of approved septic or sewage disposal system required before connection of public utilities.

No public utility, as defined in section two, article one of this chapter, may install or establish utility service to a residential or commercial structure utilizing an individual on-site septic or sewage disposal system, unless the property owner provides verification beforehand to the public utility that the structure is presently serviced or has been approved for service by a system or method of sewage or excreta disposal that has been approved in writing by the commissioner of the bureau for public health or his or her authorized representative, as required by section nine, article one, chapter sixteen of this code.


NOTE: The purpose of this bill is to require property owners to provide verification of an approved septic or sewage disposal system before public utilities may be connected to a residential or commercial structure utilizing an individual on-site septic or sewage disposal system.
