A BILL to amend article five-a, chapter thirty-five of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section nine, relating to providing perpetual care cemeteries are limited to receiving one payment of two hundred fifty dollars in return for perpetually setting memorial grave markers provided by the veterans administration.

Be it enacted by the Legislature of West Virginia:
That article five-a, chapter thirty-five of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section nine, to read as follows:
ARTICLE 5A. PERPETUAL CARE OF AND TRUST FUNDS FOR CEMETERIES.

§35-5A-9. Limitation of one charge of two hundred fifty dollars to set veterans administration grave marker.

No person who owns, operates or is employed by any perpetual care cemetery may collect more than a one-time fee of two hundred fifty dollars in return for the perpetual setting of a ground level grave marker provided by the veterans administration that is intended to mark the grave of a United States military veteran.

NOTE: The purpose of this bill is to prohibit perpetual care cemeteries from charging more than a one-time charge of $250 in return for the perpetual setting of grave markers provided by the veterans administration which mark veterans' graves.
